1. Who we are and what this is

SellSignal is operated by Clearview Limited (trading as SellSignal) (“we”). We sell a subscription giving one estate agency business (“you”) a monthly ranked list of the homes in a postcode sector, with associated estimates and flags, for use in canvassing for sales instructions. These terms govern that subscription. By purchasing you accept them on behalf of your business.

Business customers only. The service is sold to businesses for use in their trade. It is not offered to consumers, and consumer cancellation rights do not apply. A subscription belongs to the business that bought it and cannot be transferred to another business without our written agreement.

2. The service

For each sector you subscribe to we deliver, by email, a spreadsheet listing the tracked homes in that sector ranked by our model's estimate of the likelihood of coming to market in the following 12 months, with an off-market value estimate, a confidence indicator and flags derived from public records. Lists are refreshed monthly. The published record for each sector describes how the model performed on that sector in past years; it is a historical measurement, not a promise about the future. We may improve the model, the data it uses and the way the record is measured; when the measurement changes we say so on the methodology page.

3. Exclusivity

While your subscription to a sector is active we will not sell that sector to another customer. Exclusivity ends when your subscription ends, at which point the sector may be sold to anyone. Exclusivity is a commercial commitment by us; it does not restrict any other party's use of public data.

4. Price, billing and cancellation

Prices are shown on the site and charged by card through Stripe, monthly or annually in advance. Where VAT applies it is added at checkout. The rate you join at is held for as long as your subscription to that sector continues without a break. You can cancel at any time; access continues to the end of the period already paid for and no further charges are made. Because the product is delivered in full at the start of each period, fees already paid are not refundable except where the law requires.

5. What you may do with the lists

The lists are licensed to your business for its own canvassing and marketing. You may not resell, sublicense, publish or otherwise redistribute them, in whole or in part, including to other branches or businesses that are not part of your subscription; you may not scrape, bulk-extract or combine them into a database for others; and you may not use them to build a competing product. Lists contain data derived from HM Land Registry and Energy Performance Certificate records under the Open Government Licence; if you quote figures from them to third parties, attribute those sources. You are responsible for complying with the law in how you contact homeowners, including data-protection law and the rules on unsolicited marketing.

6. Data sources and accuracy

The lists are built from public and open data, including HM Land Registry price paid data and Energy Performance Certificate records, under the Open Government Licence. Those sources are incomplete and lag reality: completions take weeks to register and some marketing activity never produces a certificate. Our estimates are statistical. The off-market value is a canvassing prior produced without an inspection, photographs or an asking price; it is not a valuation and must not be presented to a homeowner or anyone else as one. Probabilities are estimates of likelihood, not predictions about any individual home. We publish how the model has performed and we do not guarantee any level of future performance, any number of instructions, or that any listed home will come to market.

7. Liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, we are not liable for loss of profit, business, instructions or data, or for any indirect or consequential loss, and our total liability to you in any 12-month period is limited to the fees you paid us in that period. The service is provided as described; we do not warrant uninterrupted or error-free delivery.

8. Termination

We may suspend or end a subscription if you breach these terms, in particular section 5, and we may withdraw the service or a sector with 30 days' notice, refunding any period paid for and not delivered.

9. General

These terms, with the Privacy Notice, are the whole agreement. We may update them; changes apply to subsequent billing periods and we will tell you by email before they take effect. English law applies and the courts of England and Wales have exclusive jurisdiction. Questions: hello@sellsignal.co.uk.
